Terms of Service.
Effective date: January 1, 2026 · Last revised: October 2026
1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you and BDP CONSTRUCTION LLC ("BDP Construction," "the Company," "we," "us," or "our"), a residential general contractor located at 2 Wilers Grv, Rittman, OH 44270, United States. The developer of this website is BDP CONSTR.
These Terms govern use of the website at www.bdpconst.shop (the "Site") and all pre-contractual interactions including inquiries and estimates. Construction work itself is governed by separate written contracts which control over these Terms wherever they conflict.
By using the Site or requesting an estimate, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. Description of Services
The Company's registered scope includes residential construction as general contractor for single-family homes — including cabins, cottages, log homes, townhouses, row houses, duplexes, vacation homes, and condominiums — and multifamily buildings including apartments, cooperatives, garden, low-rise, and high-rise structures; for-sale and merchant building on company-owned land; additions, alterations, renovations, sunrooms, and porches; fire and flood restoration; residential handyman services; and construction management for single-family, multifamily, and remodeling projects.
Site content describes capabilities in general terms and is not an offer to perform any specific work. All services are provided under written contract only.
3. Estimates, Proposals, and Contracts
- Estimates are not offers. A verbal or written estimate is an evaluation tool, not a binding price commitment, unless expressly stated otherwise in writing.
- Contracts govern. A binding agreement forms only when a written construction contract is executed by both parties. That contract — not this Site — defines scope, price, schedule, allowances, and warranties.
- Accuracy of information. Estimates depend on information you provide — site conditions, plans, access, and requirements. Material inaccuracies may require re-pricing before contract execution.
- Validity period. Written proposals are valid for the period stated in them, or 30 days if unspecified, subject to material price and labor market conditions.
4. Acceptable Use of the Website
You agree not to:
- Use the Site for unlawful purposes or in violation of these Terms;
- Submit false, misleading, or fraudulent information through forms or correspondence;
- Attempt unauthorized access to Site systems or interfere with its operation;
- Scrape or bulk-collect Site content by automated means;
- Impersonate the Company or its personnel;
- Rely on Site content as a substitute for a signed contract, permit, or engineering judgment.
5. Construction-Specific Terms
5.1 Site Conditions
Concealed conditions — soil, rock, buried utilities, hidden structural defects, undisclosed code violations — may affect scope and price. Unless expressly included, work addressing concealed conditions is handled by written change order.
5.2 Owner Responsibilities
Where we build on your land, you are responsible for:
- Legal access to the property and authority to contract for the work;
- Accurate information about boundaries, easements, utilities, and prior work;
- Timely decisions on selections, allowances, and approvals;
- A safe, accessible work area — including utilities, staging space, and site security outside our working hours.
5.3 Schedules
Construction schedules are estimates subject to weather, permitting timelines, material availability, subcontractor coordination, and owner decisions. We communicate schedule impacts promptly; completion dates are guaranteed only to the extent stated in a signed contract.
5.4 Safety and Access
Active construction areas are restricted. Unauthorized entry into a work zone is prohibited and at your own risk. Keep children, pets, and visitors clear of work areas.
6. For-Sale Properties
Homes and buildings offered for sale by the Company are sold under separate purchase agreements. Renderings, floor plans, specifications, and pricing shown on the Site or in marketing materials are illustrative and subject to change; the executed purchase agreement governs all terms of sale.
7. Warranties and Disclaimers
Workmanship and warranty terms are defined exclusively in written construction contracts and any statutory warranties required by Ohio law.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that Site content is complete, current, or error-free. Drawings, elevations, and figures on the Site are illustrative and do not constitute construction documents.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BDP CONSTRUCTION LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF USE, OR BUSINESS INTERRUPTION — ARISING FROM THE SITE OR THESE TERMS. Liability arising from construction work is governed exclusively by the applicable written contract and Ohio law. OUR AGGREGATE LIABILITY FOR SITE-RELATED CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold harmless the Company from claims, damages, and expenses — including reasonable attorney fees — arising from your breach of these Terms, your misuse of the Site, false or misleading information you provide, your failure to disclose property conditions material to contracted work, or unauthorized access to active construction areas under your control.
10. Intellectual Property
The Site's content, design, drawings, text, and the BDP CONSTRUCTION name are the property of BDP CONSTRUCTION LLC and protected by intellectual property laws. Plans, drawings, and specifications we produce remain our property unless the written contract states otherwise; unauthorized reuse of our plans on other projects is prohibited.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio. Disputes arising from the Site or these Terms shall be resolved in the state or federal courts located in Ohio. Construction contract disputes are governed by the dispute resolution provisions of the applicable contract, which may include mediation or arbitration requirements.
12. Changes and Miscellaneous
We may revise these Terms by posting an updated version on the Site. Continued use after changes take effect constitutes acceptance. If any provision is held unenforceable, the remainder continues in effect. These Terms, the Privacy Policy, and any signed contract constitute the entire agreement regarding their respective subjects.
